Terms of Service

These Terms of Service ("Terms") govern your use of the website located at vortexrestorationks.com and any services provided by Vortex Air Duct Cleaning, Restoration, General Contractor ("Vortex," "we," "our," or "us"). By accessing our site or requesting our services, you agree to be bound by these Terms.

Vortex provides emergency water extraction, flood damage restoration, mold remediation, mold inspection, trauma and biohazard cleanup, fire/smoke damage restoration, air duct and indoor air quality services, and general contracting services in Derby, Wichita, and surrounding Kansas areas. All services are subject to a separate written estimate, work authorization, or service agreement.

Quotes and estimates provided online or over the phone are preliminary approximations based on initial information. Final pricing and scope of work are determined following an on-site assessment and documented in a signed Work Authorization or Service Agreement. Due to the hidden nature of water, fire, and mold damage, additional scope adjustments may be required once structural elements or hidden cavities are opened; any scope modifications will be communicated promptly.

While we endeavor to provide rapid emergency dispatch, response times during widespread flood, storm, or biohazard emergencies are subject to demand, weather conditions, and safety protocols. For scheduled non-emergency services, we require at least 24 hours' notice for cancellations or rescheduling.

Direct Billing: Payment for non-insurance-covered services is due upon completion unless agreed upon in writing. We accept cash, check, ACH, debit, and credit card.

Insurance Claims: If you direct us to bill your insurance carrier directly, you remain ultimate responsibility for payment. You agree to execute any necessary Assignment of Benefits (AOB) or Direct Payment Authorization forms. You are personally responsible for any deductibles, non-covered services, or shortfalls not paid by your insurance carrier within 30 days of billing.

Late Fees: Past-due balances accrue interest at 1.5% per month (18% per annum) or the maximum legal rate, plus any legal fees, collection costs, or mechanic's lien enforcement costs incurred.

Authority: You represent that you own the property or possess full legal authority to authorize demolition, restoration, and remediation services on the site.

Access & Hazards: You agree to provide safe access to the work area, secure pets, and disclose all known hazardous materials (including asbestos, lead paint, structural instability, or hazardous chemicals) prior to service.

Pre-existing Damage: Vortex is not liable for pre-existing structural defects, dry rot, faulty plumbing, unpermitted construction, or pre-existing mold growth outside the defined scope of work.

We warrant that all services will be performed in a professional workmanlike manner adhering to applicable industry guidelines (including IICRC standards where applicable).

Limitation of Liability: To the maximum extent permitted by Kansas law, Vortex shall not be liable for indirect, incidental, consequential, secondary water damage, or mold regrowth resulting from unaddressed structural issues or client non-compliance with post-restoration drying guidelines.

Cap on Liability: Our maximum total liability arising out of any service or site visit is strictly capped at the total dollar amount paid by you for that specific service.

Vortex operates as a licensed general contractor (GC license #11467) in the State of Kansas and maintains commercial general liability insurance. Certificates of Insurance (COI) are available upon request.

You agree not to misuse vortexrestorationks.com, scrape content, attempt unauthorized server access, or use any site material for unlawful purposes. All content, logos, text, imagery, and intellectual property displayed on vortexrestorationks.com belong to Vortex or its licensors.

Our site may contain links to third-party resources (such as EPA guidelines, IICRC resources, or payment processors). We assume no responsibility or liability for third-party content, policies, or actions.

By submitting a request, quote form, or emergency contact form, you explicitly consent to receive calls, emails, and SMS/text communications from Vortex regarding your service inquiry. Message and data rates may apply. You may opt out of promotional SMS communications at any time by replying STOP.

We reserve the right to revise these Terms at any time. Updated versions take effect immediately upon posting to vortexrestorationks.com with a revised "Last Updated" date.

These Terms are governed by and construed under the laws of the State of Kansas, without regard to conflicts of law principles. Any dispute or litigation arising under these Terms or our services shall be filed exclusively in the state or federal courts serving Sedgwick County, Kansas.
